The Woodlands, TX Divorce Attorney Fights for Fathers’ Rights

Aggressive representation levels the playing field for dads in custody disputes

I represent both fathers and mothers, in almost equal numbers.  Even though the Texas Family Code contains gender neutral language, fathers still face an uphill battle in custody disputes. The law declares there is a presumption that joint conservatorship (legal custody) is in the best interests of the child, but there is no such presumption for joint physical custody. This makes it very difficult for dads who want 50-50 possession schedules. Judges throughout Texas still seem to favor mothers instinctively, especially when the children are of tender age. At the Law Office of Jerry Porter, we work hard to level the playing field for dads. I draw on more than 30 years of litigation experience to put together the best case possible for fathers who want to exercise their rights to be parents in the fullest sense.

No two families — or fathers — are the same

In favoring mothers as caretakers, judges are reacting to the stereotype of a nurturing mother. It may be a flattering stereotype that most of us share a fondness for, but it does not hold for every woman. Likewise, the insidious stereotype of the bumbling, out-of-touch father that’s become a staple of TV sitcoms does not hold for all, or even most, men.

As a fathers’ rights attorney, I urge the court to see my clients (and their ex-spouses) as individuals, rather than types. I’ve had success representing fathers in child custody and visitation disputes, because I’ve been able to portray their individual strengths, their character and their dedication to their children.

The importance of fathers in their children’s lives

However, even if we resist lumping all fathers together, there is much we can say positively about fathers in general. The National Fatherhood Initiative has gathered statistics supporting the assertion that many social crises are caused or worsened by the absence of a father in children’s lives. Nearly one in three American children live in a home where a biological father is absent, and 44 percent of children in mother-only households live in poverty. The absence of a father has been linked to higher incidents of juvenile delinquency, teen pregnancy and childhood obesity. There is also a correlation between the presence of a father in the home and higher academic achievement for children. For these reasons and more, the Law Office of Jerry Porter is dedicated to protecting the parental rights of fathers in The Woodlands and the greater Houston area.
