I represent both fathers and mothers, in almost equal numbers.  Even though the Texas Family Code contains gender neutral language, fathers still face an uphill battle in custody disputes. The law declares there is a presumption that joint conservatorship (legal custody) is in the best interests of the child, but there is no such presumption for joint physical custody. This makes it very difficult for dads who want 50-50 possession schedules. Judges throughout Texas still seem to favor mothers instinctively, especially when the children are of tender age. In favoring mothers as caretakers, judges are reacting to the stereotype of a nurturing mother. It may be a flattering stereotype that most of us share a fondness for, but it does not hold for every woman. Likewise, the insidious stereotype of the bumbling, out-of-touch father that’s become a staple of TV sitcoms does not hold for all, or even most, men.

The absence of a father has been linked to higher incidents of juvenile delinquency, teen pregnancy and childhood obesity. There is also a correlation between the presence of a father in the home and higher academic achievement for children.
